Illustration Commission Terms of Service

I will draw…

  • Real people/animals or fictional characters

  • Artistic nudity (not of real people or underaged characters)

I won’t draw…

  • Sexual and/or explicit material

  • Crude imagery/themes

Payment

  • Payment is usually accepted over PayPal in AUD (Australian Dollars). Prices listed include any transaction fees/taxes/conversation fees etc.

  • Jennifer requires full payment upfront before she starts the commission, unless it has been explicitly negotiated otherwise. Commissions priced above $100 AUD may be paid 50% upfront and 50% upon completion, upon request.

  • When limited availability slots are available for commissions, your slot is not confirmed until you have paid some or all of the total cost.

Process

  • Communication will be done over email.

  • After your commission has been accepted, Jennifer will send you an invoice.

  • Jennifer will ask for approval/revision notes at the following stages:
    - Sketch and rough colours
    - Line art and flat colours
    - Final

  • Three revisions are free. Additional revisions will cost an additional $10 AUD each. If an artwork has already been completed, please be aware that further changes may be unable to be made to the artwork. For traditional artworks (not digital), this is especially true, and it is best to request any changes in the sketch and rough colours stage.

  • Once started, turnaround time is from 3 days to 4 weeks per artwork, depending on complexity and medium. If you need your commission by a certain date, let Jennifer know as soon as possible to make sure her schedule works for you.

  • The sooner you reply to emails regarding any questions or artwork approval, the sooner Jennifer can keep working on it, so please keep this in mind if you’re unable to check your emails regularly.

Copyright/Usage

  • Jennifer Crow retains all rights to the artwork. She can use it to promote her artwork, as an example of a commission, as a work-in-progress on her private Patreon, and post it on her portfolio and social media accounts.

  • If you would like Jennifer to not publicly post the commission online, even temporarily (such as in the case of it being a surprise gift for someone), let her know as soon as possible.

  • You can use the artwork for personal use only. Rights to commercial use (where the commissioner makes money off the work in any way, including for promoting a business or putting it on a product) may be discussed.

  • You cannot use the artwork for AI artwork generation or learning, or for NFTs.

  • You cannot edit out Jennifer Crow’s signature on the artwork. If it has been posted online and the signature has been cropped out, credit must be given in the post description by saying the artist is Jennifer Crow, and linking to her website www.jennifercrow.com.au or her social media accounts if possible and appropriate.

Specifications and Delivery

  • Digital art will be created and delivered in RGB colour format by default - if you intend to print the commission, let Jennifer know before starting the commission so CMYK colour format can be used instead.

  • Traditional art will be shipped to the commissioner/recipient with tracking, Signature On Delivery, extra cover, and packaged as safely as possible. In addition, it will also be scanned in and delivered as a digital art file.

  • File types Jennifer usually provides for illustrations are PNG and/or PDF. If you would like other file types, just ask.

  • File types Jennifer usually provides for animated illustrations in addition to the above static file type is GIF. If you would like other file types, just ask.

Cancellations/Refunds

  • Jennifer has the right to decline a commission.

  • Jennifer has the right to cancel a commission (and will provide a full refund upon doing so).

  • Once the artwork has been started, the commissioner may cancel the commission, but will only be eligible for a partial refund depending on how much of the artwork had already been completed.

  • If you file a chargeback against Jennifer Crow at any point, your rights to the artwork will be rescinded, and she will have the rights to sell the copyrighted artwork to new buyers.

  • If you do not respond to any questions or approval check-ins within 4 weeks, the commission will be treated as abandoned, and Jennifer will cease working on it. If you return afterwards, a partial refund will be given depending on how far along the commission’s progress was.
